Illegal propagation
RAI has once again detected an illegal propagator in Italy. It concerns illegal propagation of a number of Chrysanthemum varieties of Dekker Breeding B.V. The court ordered the illegal propagator to immediately stop the cultivation and sale of the Chrysanthemum varieties concerned and imposed a fine of € 30,000 + 2% interest. In addition, the grower had to pay the verdict, the legal costs and the cost of publication in the trade journals..
RAI checks a grower in Germany for one of its clients. During that visit, the grower appears to be illegally propagating the cuttings supplied. He confesses, but does not want to sign a statement. After consultation with the breeder, RAI starts legal seizure attachment proceedings. The seizure attachment is only lifted after payment of double royalties, legal costs and attorneys’ fees.
