During a recent inspection, Royalty Administration International C.V. (RAI) found a nursery in Geldern, Germany, to be producing a variety without a licence contract which is protected under European Plant Breeders’ Rights. The owner has been fined for illegally propagating and selling a Sedum variety from Syngenta Crop Protection AG without a valid licence agreement.
July 2024, a RAI inspector visited a producer in Geldern, Germany. This visit revealed the presence of 75,000 illegal plants of the Sedum spurium ‘Spot on Deep Rose’ variety from Syngenta protected under European Plant Breeders’ Rights.
The company has been fined a double royalty rate with all associated costs to RAI of €5.500,- for this illegal propagation and sale. The producer has signed the Cease and Desist declaration, in which he declares that he will comply in the future with the rules of the European plant breeders’ rights and will no further illegal propagate or sell this or other Syngenta varieties. He must also grant RAI free access to his premises for inspection purposes.
